Mold on bathroom wall in apartment?

I have mold in my bathroom on the wall. The counter for the sink that goes on the wall warped out. We found mold. The maintenance man came out a month after we found it ( he and I saw it at the same time a month ago when he checked the sink) and he just spray painted over it. I thought since its drywall that he had to remove it. Am I wrong?
